Acceptance: Use of this site is subject to these Terms, the policies incorporated by reference, and any order-specific terms shown before purchase.

Eligibility: You must be competent to contract under Indian law and provide accurate information. We may cancel false or fraudulent orders. Any refund follows the Return & Refund Policy and applicable law

Intellectual Property: Site content is owned by Nefesh Wellness LLP, licensed to it, or used under applicable rights. No copying, scraping, or reuse without written permission.

Trademark: "Festivalwala" and its brand elements are proprietary marks of Nefesh Wellness LLP. No licence is granted without written permission.

No Agency: Nothing creates a partnership, franchise, or agency. No person may bind us without written authority.

Business Model: We sell inventory we own. Naming a manufacturer on a listing does not shift our statutory duties.

Product Information: We take reasonable care to keep descriptions, images, and prices accurate. Mandatory Legal Metrology declarations are provided on applicable products as required by law.

Price & Payment: The checkout price applies together with applicable taxes and disclosed charges. A genuine pricing or listing error discovered before fulfilment may result in correction or cancellation. Any refund follows the Return & Refund Policy. We never ask for PINs, passwords, or OTPs and do not store full card credentials.

Orders: An order is an offer and is accepted only on our confirmation. We may cancel for stock unavailability, genuine pricing or listing errors, suspected fraud, or inability to fulfil, where permitted by law. Any refund follows the Return & Refund Policy.

Delivery: You are responsible for providing a complete and correct address. Delivery windows are estimates. The Shipping & Delivery Policy governs delivery.

Transit Damage: Report transit damage within 5 working days of delivery with the order number and photographs of the package, label, and product. We verify the claim and provide the applicable remedy.

Returns: Returns are governed by the Return & Refund Policy. Nothing waives a statutory right that cannot lawfully be excluded.

Manufacturer Warranty: Where a manufacturer's warranty applies, its terms govern its scope. Our statutory obligations as seller remain separate and unaffected.

Accounts: You are responsible for securing your login and must report unauthorised access promptly. We may suspend an account to prevent fraud or abuse.

Communications: We may send transactional communications necessary to service an order. Promotional communications require consent and may be opted out of at any time.

Customer Content: You retain ownership of content you submit. You grant us a non-exclusive, royalty-free, worldwide licence to host, display, and use it to operate and promote the store. You warrant that you have the right to submit it.

Data: Personal data is governed by the Privacy Policy.

Availability: We do not guarantee uninterrupted access. We are not responsible for the independent content or practices of third-party sites we link to.

Prohibited Conduct: No fraud, hacking, malware, fake reviews, order manipulation, or unauthorised scraping. We do not use deceptive pricing, fake urgency, or forced reviews.

Liability: To the maximum extent permitted by law, our contractual liability for an order is capped at the amount paid for that order. This does not exclude or limit liability or remedies that cannot lawfully be excluded, including fraud, wilful misconduct, and statutory product liability.

Indemnity: To the extent permitted by law, you compensate us for loss directly caused by your unlawful conduct or material breach. This does not apply to loss caused by our own fault.

Force Majeure: We are not liable for delay caused by events outside our reasonable control. Statutory consumer remedies remain unaffected.

Complaints are acknowledged within 48 hours and resolved within one month.

Disputes: Contact us first. Nothing restricts your right to approach a competent Consumer Commission.

Governing Law: Indian law governs. Consumer Commission jurisdiction is preserved.

Changes: Updates apply from the stated effective date. Accrued rights survive.

Severability: If any provision is invalid or unenforceable, the remaining provisions continue.

Entire Agreement: These Terms, Privacy Policy, Return & Refund Policy, Shipping & Delivery Policy, Legal Notice, Contact Information, and order-specific terms shown before purchase together form the contract.
